1. General conditions

The following general conditions of sale apply to all contracts, all shipments and all services performed at a distance and made available through the internet from the site http://bupress.unibz.it. Any exceptions must be confirmed in writing by Bozen-Bolzano University Press.

2. Seller’s details

The seller is the Free University of Bozen/Bolzano – Bozen-Bolzano University Press, located in 39100 Bolzano, Piazza Università 1, Tel. 0039 0471 012 332, universitypress@unibz.it, http://bupress.unibz.it.

3. Conclusion of the contract

At the time of the order, which is irrevocable, the purchaser expresses a binding offer to purchase. The contract is concluded with the sending of the order confirmation by the seller to the email address of the purchaser.

4. Delivery and payment

Unless otherwise agreed, shipments will be delivered to the address indicated by the purchaser. The shipping costs are the responsibility of the purchaser. All costs resulting from incorrect, incomplete or unclear information will be borne by the purchaser.

The invoice is attached to the shipment. The prices are final prices in Euros including VAT. The payment of the sale price must be made in advance by bank transfer and / or credit card. Any bank charges are to be borne by the purchaser and must not be deducted from the sale price.

There is no minimum order. To speed up the progress of the order, the seller reserves the right to make partial deliveries. All shipments are at the purchaser’s risk.

5. Delivery terms

The indications concerning delivery times are not binding. Goods will be dispatched as soon as possible – and no later than 30 days after the order – to the address indicated. The delivery depends on the time the order is received (during office hours). Delivery is though the Italian postal service or by courier.

6. Warranty and liability

If the merchandise is defective, a request may be made for the elimination of the defect or to replace the article. In any case, if goods are returned, these delivery costs are to be borne by the purchaser. If a defect is identified, either the defect will be rectified or the article will be replaced; in the event that the costs or time needed for the replacement is excessive, the article will not be replaced. In this case the purchaser may choose to withdraw from the contract or demand a reduction of the corresponding purchase price.

The seller is not responsible for any technical failures in the operation of its online ordering system.

7. Right of return

Special provisions for consumers

These provisions apply only to purchasers who are regarded as consumers as per the Law on Consumer Protection. “Customer Consumer” means a natural person who purchases the products or services offered on the website for purposes unrelated to business or a professional activity; to the effects of these terms and conditions, it is assumed that the “Customer Consumer” is not a client who proposes to purchase products or services at the same time inserting their VAT number in the customer registration area of the website. Articles 50 to 63 of the legislative decree no. 206/2005 apply to the Purchase Contracts entered into by Customer Consumers.

Under Article 64 of the Law on Consumer Protection (legislative decree 206/2005) in the context of distance contract proposals or contracts negotiated away from business premises, the consumer is entitled to withdraw within ten working days from receipt of goods. The withdrawal must be made by registered mail and sent to the Free University of Bozen/Bolzano, Bozen-Bolzano University Press, Piazza Università 1, 39100 Bolzano. The withdrawal may also be sent by telegram, telex, e-mail or fax if it is followed by a registered letter within 48 hours.

The refund of the purchase price will occur once the goods have been returned undamaged and unused. The goods must be returned to Bozen-Bolzano University Press within ten days from exercising the right of withdrawal. The return costs shall be borne by the consumer. If the returned goods are damaged, used or incomplete, the buyer must provide compensation in proportion to the decrease in the value of the goods. There is no right of withdrawal in accordance with the law on the protection of consumers with regard to newspapers and magazines, as well as to audio and video media and software products, if not returned in their original sealed packaging.

8. Reservation of proprietary rights

The goods supplied remain the property of Bozen-Bolzano University Press until final payment has cleared.

11. Jurisdiction and applicable law

The purchase contract is undertaken in Italy and governed by Italian law. The judicial authorities in Bolzano shall have exclusive jurisdiction in any dispute on the understanding of the applicability of the standards required by law for the protection of consumers.

Pursuant to and for the purposes of articles 1341 and 1342, the purchaser acknowledges that s/he has read, understood and agreed to the following terms, whose titles are shown only as an example: Art. 6 Warranty and liability, Art. 7 Right of Return, 11 Jurisdiction and applicable law.
